Despite the fact that there has been a great deal of comment lately about DIY Will writing and non-legal, cut-price Will writing services, it is still recognised that having your Will prepared by a fully-qualified and highly experienced law firm, that is authorised and regulated by the Solicitors Regulation Authority, is still the best and most secure way to ensure that your assets are distributed exactly as you would wish after your death.

For this professional service, we have developed a very competitive scale of fixed fees so that you know, in advance, exactly what the cost of making a Will should be.

As part of our fixed fee’s we have included Probate fees and the cost to arrange Lasting Power of Attorney. The fees do not include VAT. The fixed fee of £595 + VAT @ 20% assumes that you are able to provide us with a full list of the deceased’s assets and liabilities in a single document (i.e. Word or Excel), a full inheritance tax return is not required and there is no dispute about the estate. It does not include the costs of us gathering in the assets or distributing them. This process takes about 8 weeks.

The work involved in obtaining the grant of probate/letters of administration include: initial meeting, going through the document/s provided which include all the assets and liabilities, preparing and sending the online form and obtaining the grant.

All work relating to wills, probate and lasting powers of attorney will be carried out by Mark Higgins who has been a solicitor since 1993 dealing with these matters as well as family and matrimonial cases throughout that time

If you require us to organise and manage the entire Probate process and not simply arrange for Grant of Probate in order that you can wind up the estate yourself, then it will be more cost effective for our services to be charged at an hourly rate which is currently £195 – £255 per hour plus VAT @ 20%.

If you want us to manage the entire probate process for you we can. The fees depend upon the complexity of the matter and the extent of the assets and liabilities. They will be higher for example if there is inheritance tax to pay.

At the outset of your instruction we will explain to you clearly what costs we think that you will incur. If that estimate changes during your case we will let you know. A typical fully managed probate matter with a valid will, no more than 2 executors, 3 bank accounts, a house and no substantial debts and no inheritance tax to pay will cost in the region of £3500 plus VAT @ 20% and disbursements. The conveyancing costs associated with any house sale will be charged separately as that is not work that we undertake. Typically the process will take between four and six months.

The fees will rise for example if there are multiple bank accounts, multiple beneficiaries, there are significant liabilities or where we need to make arrangements to deal with household contents and personal items and their distribution. There are also disbursements that are likely to be incurred: probate registry fees: £273 (if estate is over £5000), ID checks for clients who are new to the firm: £8 per person, bankruptcy search: £2 + vat @ 20%, bank transfer (within the UK) £35
